These Terms of Use ("Terms") govern your access to and use of carnivalofmasks.com (the "Site"), operated by Carnival of Masks. ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Who We Are

Carnival of Masks is a feature documentary about the mask-makers and costume designers of Venice, Italy's Carnevale. The Site is used to share information about the film, connect with community members and prospective subjects, facilitate sponsorships and partnerships, and support fundraising through our fiscal sponsor.

2. Use of the Site

You may use the Site for personal, non-commercial purposes to learn about the documentary, engage with our community, submit inquiries, or support the project. You agree not to:

  • Copy, download, scrape, reproduce, distribute, publicly display, or create derivative works from any content on the Site (including photographs, text, video, or design elements) without our prior written permission or the permission of the applicable rights holder

  • Use any automated system (bot, scraper, crawler) to access or extract content or data from the Site

  • Use the Site for any unlawful purpose or in violation of any applicable law

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

  • Interfere with or disrupt the Site's functionality or servers

  • Submit false, misleading, or infringing content through any form on the Site

We reserve the right to restrict or terminate access to the Site for anyone who violates these Terms.

3. Intellectual Property

3.1 Our Content

The Site's design, layout, text, logos, and original documentary materials are owned by Carnival of Masks or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted in these Terms, no content from the Site may be reproduced, republished, or used commercially without our prior written consent.

3.2 Third-Party and Contributor Content

Certain photographs and images on the Site were provided to us by third-party photographers, artisans, and community members, and remain the property of their respective owners. These images are used with the permission of the rights holder for purposes related to promoting the documentary and this project. They are not licensed for reuse by Site visitors — the same restrictions in Section 2 apply. If you are a rights holder and believe your work appears on the Site without proper authorization, please contact us immediately using the process in Section 8 so we can address it promptly.

3.3 User Submissions

If you submit a story, photo, video, or other content to us (for example, through the voluntary interview submission form or by email), you represent that you own the rights to the content or have permission to share it, and you grant Carnival of Masks a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, and display that content in connection with the documentary and its promotion. You may withdraw this permission for future use by contacting us, though we cannot recall content already incorporated into distributed or published materials. This license does not transfer ownership of your content to us.

Formal appearance releases, footage licenses, and compensation terms for documentary subjects are handled separately and are not governed by this Section.

4. Third-Party Links and Tools

The Site links to or embeds third-party services, including Google Forms, Substack, Allyra Fundraising, the International Documentary Association (IDA), our Trip Planner tool, and social media platforms (Facebook, Instagram, TikTok, YouTube). We do not control these third parties and are not responsible for their content, policies, or practices. Your use of them is subject to their own terms and privacy policies.

5. Donations

Donations made in support of the documentary are processed through our fiscal sponsor, the International Documentary Association, and/or Allyra Fundraising. Donations are generally non-refundable except as required by law or as determined by the fiscal sponsor's policies. Tax-deductibility, if applicable, is governed by the fiscal sponsor's status and documentation, not by Carnival of Masks directly.

6. No Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the fullest extent permitted by law, Carnival of Masks, its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed one hundred dollars ($100).

8. Copyright Complaints

If you believe content on the Site infringes your copyright or was used without proper authorization, please contact us with:

  1. A description of the copyrighted work you believe is infringed

  2. The specific location of the material on the Site

  3. Your contact information

  4. A statement that you have a good-faith belief the use is unauthorized

We will investigate and, where appropriate, remove or restrict access to the material in question.

9. Indemnification

You agree to indemnify and hold harmless Carnival of Masks and its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or content you submit that infringes the rights of a third party.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in California.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above will reflect the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
